1. About these terms
These terms apply when you order a film from Holibusters ("we", "us") through this website. When you send an order, you agree to them. Please read them with our Privacy Policy, Refunds page and Cookies page. To contact us about anything here, email info@holibusters.com.
These terms are for people ordering a film for themselves and their family, not for businesses.
2. What we make
We make a personalised, funny film from the holiday photos, videos and answers you send us. Each film is made to order just for you. It's a digital service: we don't post anything, and you get your film by a private download link.
- Trailer: about 3 minutes, from up to 100 photos and 5 minutes of video. This is the film on offer right now.
- Standard (about 8 minutes) and Epic (about 20 minutes): coming soon. These terms will apply to them too when they open.
Running times are approximate. The length depends on what you send us.
3. The free Trailer offer
- For our launch, we're offering a free Trailer to the first 10 families who send us a complete order. When they've gone, the order form will say so.
- The offer is up to us. We decide whether an order qualifies, and we can change, pause or end the offer at any time, including before all 10 have gone.
- One free Trailer per family. There's no cash alternative, and the offer can't be swapped for a different film.
- Free means free: you pay £0 for your Trailer and we don't ask for a card. We'll never charge you for anything unless you've agreed to it first (see section 9).
4. Your order
- When you send your order, you're asking us to make your film. We accept it when we email you to say your film is in production, or when we start work on it, whichever comes first.
- We can refuse, pause or cancel any order at any time, before or after we accept it. For example, we might do this if your photos or videos can't be used, if we think someone shown hasn't agreed to be in the film, if anything you send is unlawful or offensive, if we're too busy, or if the free offer has ended. If we do, we'll tell you, and if you've paid anything for that order, we'll refund it.
- Please make sure your email address is right. We use it to send your preview and your film.
5. Your photos and permissions
When you send us photos, videos, face photos, a hello clip, a shared album link or answers, you promise that:
- you took them, own them, or have permission from whoever does to send them to us and to have them made into a film;
- everyone who appears in them, or is named in your answers, is happy to be in the film;
- you're the parent or guardian of any children in them, or you have the permission of each child's parent or guardian;
- nothing you send is unlawful, indecent, or breaks anyone else's rights, such as copyright or privacy; and
- the details you give us are true.
If any of this isn't true, we can cancel your order and delete what you sent. As far as the law allows, you're responsible for any claim made against us because you sent us something you didn't have the right to send.
6. How we use your media
- Your photos and videos stay yours. You give us permission to copy, store, edit and process them and your answers, including with AI editing tools, only to make, deliver and change your film, and to keep our order system running and secure.
- We will not use your photos, videos or film for marketing, show them to other customers, share them publicly or use them to train AI unless you give us separate written permission. Saying yes to a film doesn't mean saying yes to anything else.
- Our permission ends when your media is deleted (see section 11).
7. Creative decisions
We're the editors. We decide how your film is made, including which photos and clips go in, the order, the titles, captions, jokes, music and style. We may leave things out, for example if they're blurry, too dark, too long, over your ticket's limits or not suitable. We'll follow your "leave out" notes and the tone you choose as best we can. Music is licensed library music, not chart songs. A film you don't like the taste of isn't a faulty film, but you can use your change round to ask for tweaks.
8. How long it takes
We aim to send your film in about 48 hours after we have everything we need. That's an aim, not a guarantee: busy times, big orders, problems with your files or your link, or things outside our control can make it take longer. We'll always make your film within a reasonable time, and we'll let you know if it's running late.
9. Your preview and changes
- We send you a preview before your final film.
- Each order includes 1 free round of up to 10 changes. Send all your changes together in one message. A change is one specific edit, such as swapping a clip, fixing a name or changing a caption.
- After your free round, each extra round of up to 10 changes costs £10. We'll tell you before we start an extra round, and we only do it if you agree.
- Changes have to be to the film we made. Starting again, adding a lot of new photos or videos, or switching to a different film counts as a new order.
- Unused changes don't carry over.
- If something is our mistake, such as a name we spelt wrong when you gave it to us right, we fix it free and it doesn't count as one of your changes.
10. Your film
- We send your final film by a private download link. The link lasts 30 days from when we deliver your finished film (if no delivery date is recorded, from when we first send you a film link). After that, the film and the link are deleted automatically, so download your copy before then.
- You can keep, watch and share your film with family and friends, including on your own social media. Please don't sell it or use it for business, because the music and graphics are licensed for personal use.
- You own your photos and videos. We (or the people we license from) own the rights in the edit, titles, graphics and music. We give you permanent permission to use the finished film for personal purposes.
11. Deleting your photos and videos
Your photos and videos, including any face photos and hello clip, are deleted automatically 30 days after you first upload them (or after you first send us a link). This happens even if your film isn't finished by then. If we still need something after that, we'll ask you to send it again. We're not a backup service, so please keep your own copies. Read more in our Privacy Policy.
12. Prices and payment
Our prices are Trailer £29, Standard £59 and Epic £89, in pounds sterling, with no VAT to add. During the launch offer, free Trailers cost £0 and we don't take any payment or card details. If we start taking payments, we'll show the price before you order.
13. Cancelling
- You can cancel a free order at any time before we send your final film. Email info@holibusters.com with your order number, and we'll stop and delete your photos and videos.
- Your 14-day right to cancel. Under the Consumer Contracts Regulations, you usually have 14 days to cancel an online order. When you send your order, you ask us to start making your film straight away. That means you lose your right to cancel once we've finished making your film. If you cancel a paid order during the 14 days but before your film is finished, we may keep a fair amount for the work we've already done.
- We can cancel too, as set out in section 4.
- For refunds, see our Refunds page.
14. Our responsibility to you
- If we break these terms, we're responsible for loss you suffer that was a foreseeable result of that. We're not responsible for loss that wasn't foreseeable.
- As far as the law allows, our total responsibility to you for an order is limited to the amount you paid for it. For a free Trailer, that's £0.
- We're not responsible for business losses, or for losing your original photos and videos. Please keep your own copies.
- We're not responsible for delays or problems caused by things outside our reasonable control, such as internet, hosting or email outages.
- If digital content we supply damages your device or other digital content, and that's because we didn't use reasonable care and skill, we'll repair the damage or pay you fair compensation.
- Nothing in these terms limits or excludes our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit or exclude.
15. Your legal rights
Nothing in these terms affects your statutory rights. Under the Consumer Rights Act 2015, we must make your film with reasonable care and skill, and the film must be of satisfactory quality and match how we've described it. If it doesn't, you're entitled to have it put right, and in some cases to a price reduction or refund. For more on your rights, contact Citizens Advice.
16. Everything else
- We may update these terms from time to time. The terms on this page when you send your order are the ones that apply to it.
- If a court decides part of these terms can't be used, the rest still applies.
- Only you and we have rights under these terms. Nobody else can enforce them.
- If we don't enforce something straight away, we can still do it later.
- These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
- Something gone wrong? Email info@holibusters.com first and we'll do our best to put it right.
